  </p>

  <h2>1. Definitions</h2>
  <ul>
    <li>
      <strong>"FerrLens"</strong>: the free web-tools suite edited by Bryan Ferrando —
      Entrepreneur individuel (FerrLabs), SIREN 104 243 951, accessible at ferrlens.com with an
      API at api.ferrlens.com.
    </li>
    <li>
      <strong>"Tools"</strong>: the utilities offered by FerrLens (SEO checks, DNS lookups,
      email-deliverability and SPF/DKIM/DMARC checks, security-header analysis, developer
      utilities, etc.).
    </li>
    <li>
      <strong>"User"</strong>: any person using the Tools or the API, with or without an
      account.
    </li>
    <li>
      <strong>"Account"</strong>: a free FerrLabs account that adds tool history and higher
      limits.
    </li>
    <li>
      <strong>"Subscription"</strong>: a paid plan (Pro) that adds batch processing and an API
      quota.
    </li>
  </ul>

  <h2>2. Acceptance</h2>
  <p>
    Use of the Service implies unreserved acceptance of these terms. The Customer acknowledges
    having read and accepted them prior to any subscription.
  </p>

  <h2>3. Service description</h2>
  <p>FerrLens provides:</p>
  <ul>
    <li>A suite of free web tools, usable anonymously in the browser at ferrlens.com</li>
    <li>An HTTP API at api.ferrlens.com that runs the same checks programmatically</li>
    <li>For signed-in accounts: tool history and higher rate limits</li>
    <li>For Pro subscribers: batch processing and a larger API quota</li>
  </ul>

  <h2>4. Access tiers and subscription</h2>
  <p>
    Current pricing is published at
    <a href="https://ferrlens.com/pricing">ferrlens.com/pricing</a>. Access is offered at three
    levels:
  </p>
  <ul>
    <li>
      <strong>Anonymous</strong>: free use of the Tools and API, subject to a per-IP rate limit
    </li>
    <li><strong>Account</strong>: free; adds tool history and higher rate limits</li>
    <li>
      <strong>Pro</strong>: paid; adds batch processing and an API quota according to the
      published price schedule
    </li>
  </ul>
  <p>
    Beyond the rate limit or quota of a given tier, requests may be throttled or rejected until
    the limit resets.
  </p>

  <h2>5. Payment</h2>
  <p>
    Payments are made through Stripe Inc. (United States, Data Privacy Framework certified), by
    credit card or SEPA direct debit. The Customer expressly authorizes monthly automatic debit.
    Each invoice is issued on the subscription anniversary date.
  </p>

  <h2>6. Term, renewal and termination</h2>
  <p>
    The Subscription is concluded without commitment, and is tacitly renewed each month on the
    anniversary date. The Customer can terminate at any time from their account area
    (termination takes effect at the end of the current billing period). No pro-rata refund.
  </p>
  <p>
    In accordance with the French law of 16 August 2022, termination is accessible by means at
    least as simple as subscription.
  </p>

  <h2>7. Right of withdrawal (consumers only)</h2>
  <p>
    In accordance with article L.221-18 of the French Consumer Code, a Customer who is a
    consumer has a 14-day period to exercise their right of withdrawal.

    upon subscription. This waiver is materialized by the checkbox at payment time.
  </p>

  <h2>8. Acceptable use</h2>
  <p>The User undertakes to use the Tools and the API lawfully. In particular, the User must not:</p>
  <ul>
    <li>
      Use a Tool to attack, probe or disrupt a third party without authorization, or to
      facilitate any intrusion, denial of service or other unlawful act against a system the
      User does not own or is not permitted to test
    </li>
    <li>
      Circumvent the rate limit or API quota (rotating IPs, sharing tokens, automated scraping
      of the web interface)
    </li>
    <li>
      Resell, redistribute or republish the Tools or their output as a competing service
    </li>
    <li>
      Submit input that infringes a third party's rights or that is illegal under French law
    </li>
  </ul>
  <p>
    The User is solely responsible for the input they submit and for how they use the results.
    They undertake to indemnify FerrLens against any claim, judgment, or defense costs arising
    from a misuse of the Tools or the API.
  </p>

  <h2>9. Availability and liability</h2>
  <p>
    FerrLens is provided on an "as is" basis as a free / freemium service. As such:
  </p>
  <ul>
    <li>
      FerrLens makes no guarantee as to the accuracy or completeness of a Tool's results, which
      are informational and depend on third-party data sources (DNS, certificate authorities,
      remote servers, etc.)
    </li>
    <li>
      FerrLens may rate-limit, throttle or temporarily suspend access to protect the service
    </li>
    <li>
      To report abuse of the Tools or API, or a security issue, use the procedure published at
      <a href="/abuse/">ferrlens.com/abuse</a>
    </li>
  </ul>

  <h2>10. Suspension and termination for cause</h2>
  <p>
    FerrLens may suspend or terminate access (including a Subscription), without notice or
    refund, in case of:
  </p>
  <ul>
    <li>Use of the Tools or API to attack or abuse a third party</li>
    <li>Circumvention of rate limits or API quota</li>
    <li>Payment default of more than 15 days (Pro)</li>
    <li>Serious breach of these terms</li>
    <li>Attempted attack on the infrastructure (abuse, spam, fraud)</li>
  </ul>

  <h2>11. Personal data</h2>
  <p>
    Personal data is processed in accordance with the privacy policy published at
    <a href="/privacy/">ferrlens.com/privacy</a>. FerrLens is the data controller for account
    data and for the limited data processed to run the Tools (such as a transiently used IP
    address for rate limiting). Anonymous tool inputs are processed for a single request and are
    not retained.
  </p>

  <h2>12. Intellectual property</h2>
  <ul>
    <li>
      The FerrLens source code, the "FerrLabs" and "FerrLens" trademarks, and all associated
      graphical elements remain the exclusive property of Bryan Ferrando — Entrepreneur
      individuel.
    </li>
    <li>
      The input you submit to a Tool remains yours. You grant FerrLens only the transient,
      non-exclusive license needed to process that input and return the result for the duration
      of the request.
    </li>
  </ul>

  <h2>13. Limitation of liability</h2>
  <p>
    FerrLens is bound by an obligation of means. FerrLens's liability is limited to direct
    foreseeable damages and shall not exceed, in any event, the amounts paid by the Customer
    over the past 12 months. FerrLens is not liable for indirect damages (loss of revenue,
    loss of data not backed up by the Customer, reputational harm).
  </p>
  <p>
    FerrLens is not liable in case of force majeure (infrastructure subcontractor outage, DDoS
    attack, network unavailability).
  </p>

  <h2>14. Modification of terms</h2>
  <p>
    FerrLens reserves the right to modify these terms. Any modification is notified to the
    Customer by email at least 30 days before its entry into force. Failing express opposition
    by termination within this period, the new terms are deemed accepted.
  </p>

  <h2>15. Applicable law and jurisdiction</h2>
  <p>
    These terms are governed by French law. For any dispute with a professional Customer,
    exclusive jurisdiction of the courts of Lille.
  </p>
  <p>
    For any dispute with a consumer Customer, in accordance with article L.612-1 of the French
    Consumer Code, the Customer may have free recourse to a consumer mediator. Designated
    mediator: <span class="placeholder">[À COMPLÉTER — ex : CMAP, Médicys]</span>.
  </p>

  <h2>16. Final provisions</h2>
  <p>
    The possible nullity of a stipulation does not entail the nullity of the whole. FerrLens's
    failure to exercise a right cannot be interpreted as a waiver.
